Terms of Service for Premier Optical Boutique

These Terms of Service (“Terms”) govern your access to and use of the website
www.premieroptical.ca (the “Site”) and the services provided by Premier Optical Boutique (“we,” “us,” “our”). By accessing or using the Site, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please refrain from using the Site.
1. Acceptance of Terms
By accessing and using the Site, you confirm that you have read, understood, and agree to these Terms, as well as our Privacy Policy, which is incorporated by reference. In accordance with the
Electronic Commerce Act, 2000 (Ontario), you agree that these Terms may be accepted electronically and that such acceptance has the same legal effect as a written signature.
2. Services
Premier Optical Boutique offers a range of eye care services, including comprehensive eye exams, consultations, and eyewear products such as
designer frames, sunglasses, and contact lenses. Eye examinations are performed by licensed optometrists regulated by the College of Optometrists of Ontario. Services are subject to availability and may be modified or discontinued at any time without prior notice.
3. No Medical Advice
Content on the Site is provided for general informational purposes only and does not constitute optometric, medical, or other professional health advice. No optometrist-patient relationship is created by your use of the Site. Always consult a licensed eye care professional regarding your vision and
eye health. If you are experiencing an eye emergency, contact us, your physician, or your nearest emergency department immediately.
4. Appointment Bookings
Users can schedule eye exam appointments through the Site. By booking an appointment, you agree:
- To attend at the scheduled time.
- To provide at least 24 hours’ notice for cancellations or rescheduling. Failure to attend or provide adequate notice may result in fees or restrictions on future bookings. Any such fees will be disclosed to you before they are charged.
5. Product Information
We aim to ensure that all product descriptions, images, and prices on the Site are accurate. However, we do not guarantee that the information is free from errors, inaccuracies, or omissions. In the event of an error, we reserve the right to correct it without prior notice, including after an order has been placed. Where a correction materially affects an order you have placed, we will notify you and offer the option to confirm or cancel the order.
6. Pricing and Payment
All prices are listed in Canadian Dollars (CAD) unless otherwise stated. In accordance with Ontario consumer protection law, the total price payable, including any mandatory fees and applicable taxes, will be disclosed to you before you complete a purchase. We reserve the right to modify prices at any time without prior notice; price changes do not affect orders already confirmed. Payment for services and products is due at the time of purchase or upon receipt of services unless otherwise agreed.
We accept various payment methods, and you are responsible for providing accurate and valid payment information.
7. Intellectual Property
All content on the Site, including but not limited to text, graphics, logos, images, videos, and software, is the property of Premier Optical Boutique or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, or otherwise exploit any content without prior written permission from us.
8. Privacy and Personal Health Information
Your use of the Site is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information in accordance with the
Personal Information Protection and Electronic Documents Act (PIPEDA). Personal health information collected in connection with eye examinations and related clinical services is handled in accordance with the
Personal Health Information Protection Act, 2004 (PHIPA), under which our optometrists act as health information custodians. You have the right to access and request correction of your personal health information, and to withdraw consent to certain uses, subject to applicable law. Privacy inquiries or complaints may be directed to our privacy contact at info@premieroptical.ca; you also have the right to complain to the Information and Privacy Commissioner of Ontario or the Office of the Privacy Commissioner of Canada.
9. Electronic Communications (CASL)
In compliance with Canada’s Anti-Spam Legislation (CASL), we will only send you commercial electronic messages, such as promotions or newsletters, with your consent or as otherwise permitted by law. Transactional messages, such as appointment confirmations and reminders, are not marketing messages. You may withdraw your consent to marketing communications at any time using the unsubscribe mechanism in any message or by contacting us at info@premieroptical.ca.
10. Accessibility
We are committed to providing goods, services, and facilities in a manner that respects the dignity and independence of persons with disabilities, consistent with the
Accessibility for Ontarians with Disabilities Act, 2005 (AODA). If you encounter an accessibility barrier on the Site or in our store, or require materials in an alternative format, please contact us and we will work with you to accommodate your needs.
11. Consumer Protection Rights
If you are a consumer, you have rights under the
Consumer Protection Act (Ontario) and other applicable consumer protection legislation, including deemed warranties and conditions that goods are of reasonably acceptable quality and that services are performed with reasonable skill. Nothing in these Terms excludes, limits, or waives any right, warranty, condition, or remedy that applicable law does not permit to be excluded, limited, or waived. In the event of a conflict between these Terms and your statutory consumer rights, your statutory rights prevail.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Premier Optical Boutique, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of your use of the Site or any products or services obtained through it. This limitation does not apply to liability that cannot be excluded or limited under applicable law, including liability arising under the
Consumer Protection Act (Ontario), liability for personal injury caused by negligence, or liability arising from professional obligations owed by our regulated health professionals.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Subject to any rights you may have as a consumer under applicable law, including the right to commence a proceeding in the courts of Ontario or to participate in a class proceeding, disputes arising under or in connection with these Terms will be resolved in the courts of Ontario. Nothing in these Terms requires you to waive your right to commence or participate in a class proceeding or to bring a claim before a court where such waiver is prohibited by law.
14. Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes, we will update the “Effective Date” at the top of this page, and where required by law we will provide you with notice of material changes. Your continued use of the Site after such changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms regularly.

16. Disclaimer of Warranties
Except as expressly provided in these Terms, and subject to any warranties, conditions, or guarantees that cannot be excluded under applicable law (including deemed warranties under the
Consumer Protection Act (Ontario) and the
Sale of Goods Act (Ontario)), the Site is provided on an “as is” and “as available” basis without warranties of any kind, express or implied. We make no guarantees that the Site will be secure, uninterrupted, or error-free. This section applies to the Site itself and does not limit the statutory warranties applicable to products you purchase or services you receive from us.
17. User Accounts
If you create an account on the Site, you are responsible for maintaining the confidentiality of your account information and password. You agree to accept full responsibility for all activities conducted under your account and agree to notify us immediately of any unauthorized use or security breach. We reserve the right to suspend or terminate accounts for cause, including violation of these Terms.
18. Product Returns and Exchanges
Our return and exchange policy for eyewear products will be provided at the time of purchase. Please note that prescription lenses are custom-made to your specifications and are generally non-refundable, except in the case of manufacturer defects or errors on our part. Non-prescription products may be eligible for returns or exchanges in accordance with our policy. Nothing in this section limits your statutory rights or remedies under Ontario consumer protection law, including remedies for goods that fail to meet deemed warranties.
19. Termination
We reserve the right to terminate or suspend your access to the Site, with or without notice, for any reason, including but not limited to a violation of these Terms. Upon termination, your right to use the Site will immediately cease. Termination of Site access does not affect your rights in respect of products already purchased or health services already received, or our obligations regarding your personal health information.
20. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Premier Optical Boutique, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from your misuse of the Site or your violation of these Terms.
21. Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Premier Optical Boutique concerning your use of the Site and supersede any prior or contemporaneous agreements, communications, or proposals. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
